Comprehensive Booking Terms & Conditions
3.1 Formality of the Contractual Agreement
A finalized binding operational contract is acknowledged only when Kudu Untamed Safaris distributes a finalized, written confirmation alongside an itinerary-linked invoice. This follows successful processing of the required initial deposit allocation through our corporate clearance accounts.
3.2 Financial Matrix: Payment Profiles & Timelines
- Initial Security Deposit: A mandatory payment of thirty percent (30%) of the complete quoted value must clear into our accounts to lock in tracking allocations, peak-season lodge rooms, and regional aviation links.
- Final Balance Settlement: The remaining balance of seventy percent (70%) must be verified in our corporate ledger no later than sixty (60) days prior to your specified safari commencement date.
- Late Request Protocols: Itinerary applications initiated within sixty (60) days of departure require instant full payment (100%) to authorize procurement sweeps.
3.3 Cancellations and Forfeiture Tiers
All structural cancellation notices must be dispatched via email by the primary booking traveler. Due to non-recoverable outlays with remote hospitality lodges and local preservation zones, the following fee structures are legally binding:
| Cancellation Window Prior to Departure | Retained Liquidated Damages Matrix |
|---|---|
| 61 Days or more | Forfeiture of the complete 30% Initial Security Deposit. |
| 45 Days to 60 Days | Forfeiture of fifty percent (50%) of the comprehensive invoice total. |
| 30 Days to 44 Days | Forfeiture of seventy-five percent (75%) of the comprehensive invoice total. |
| Less than 30 Days | Forfeiture of one hundred percent (100%) of the comprehensive invoice total. |
Strict Statutory Exception Rule Regarding Wildlife Permits: Gorilla trekking allocations (Uganda Wildlife Authority / Rwanda Development Board) and specific high-demand seasonal concessions are completely non-refundable and non-transferable by law. They stand entirely outside standard cancellation provisions and require 100% forfeiture upon confirmation.
3.4 Mandatory Insurance Matrix
It is an unalterable operational requirement of booking an excursion that every participant maintain a valid international comprehensive travel insurance layout. The coverage parameters must explicitly insulate against emergency aeromedical extraction inside East Africa, specialized clinical care costs, trip curtailments, and baggage loss.
3.5 Jurisdictional Governing Law
This organizational contractual structure, operational codes, and all legal parameters arising from it are governed exclusively by the laws of the Republic of Kenya. All parties submit to the exclusive territorial jurisdiction of the courts of Nairobi, Kenya.
